1. Acceptance of Terms

Welcome to Creato. These Terms of Service ("Terms") constitute a legally binding agreement between you and Creato ("we," "our," or "us") governing your access to and use of the Creato platform, including our website located at creato.biz.id, mobile applications, APIs, and all related services, features, and content (collectively, the "Platform").

By accessing, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform under any circumstances.

We reserve the right to modify, amend, or update these Terms at any time in accordance with Section 14 below. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

Important: These Terms apply to all visitors, users, creators, and others who access or use the Platform. By using Creato, you represent that you have the legal capacity to enter into a binding contract.

2. Eligibility

To use the Creato Platform, you must meet the following eligibility requirements:

    Minimum Age Requirement
    You must be at least 13 years of age to use the Platform. If you are between 13 and 17 years old (or the applicable minimum age of digital consent in your jurisdiction), you may only use the Platform with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

    Legal Capacity
    You must have the legal capacity and authority to enter into a binding agreement. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

    No Prior Suspension or Ban
    You must not have been previously suspended, terminated, or banned from the Platform by Creato. Any attempt to create a new account after a termination is a violation of these Terms.
  • 4
    Compliance with Laws
    You must not be located in, under the control of, or a national or resident of any country or territory subject to sanctions or embargoes under applicable law, including but not limited to comprehensive sanctions programs.

Warning: Misrepresenting your age or eligibility to gain access to the Platform is a violation of these Terms and may result in immediate termination of your account without notice.

3. Account Registration & Security

3.1 Registration Requirements

To access certain features of the Platform, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information during the registration process
  • Maintain and promptly update your account information to keep it accurate and complete
  • Use a valid and unique email address that you own and control
  • Create a strong password that is not easily guessable and that you do not use on other services
  • Be at least the minimum age required for eligibility as stated in Section 2

3.2 Account Security Responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any other access tokens. You agree to:

  • Keep your password confidential and not share it with any third party
  • Immediately notify us at security@creato.biz.id if you suspect any unauthorized use of your account or any security breach
  • Log out from your account at the end of each session when using a shared or public device
  • Enable two-factor authentication (2FA) when available for enhanced security
  • Not allow any other person to access the Platform through your account

3.3 Liability for Account Activity

You are fully responsible for all activities that occur under your account, regardless of whether such activities were authorized by you. If you fail to maintain the security of your account and a third party gains access, Creato shall not be liable for any losses or damages arising from such unauthorized access.

Security Best Practice: We strongly recommend using unique passwords for Creato and enabling two-factor authentication. If you notice any suspicious activity on your account, contact our security team immediately at security@creato.biz.id.

4. User Conduct

As a user of the Creato Platform, you agree to conduct yourself in a manner that is lawful, respectful, and consistent with the community standards outlined in these Terms. The following standards apply to all interactions on the Platform:

    Respectful Communication
    Treat all users with respect and dignity. Engage in constructive and positive communication. Harassment, bullying, hate speech, and discriminatory behavior will not be tolerated under any circumstances.

    Authentic Engagement
    Participate genuinely on the Platform. Do not use bots, fake accounts, or automated systems to artificially inflate engagement metrics such as views, likes, shares, or followers.

    Content Responsibility
    You are solely responsible for all content you upload, post, share, or otherwise transmit through the Platform. Ensure that your content does not violate the rights of any third party or applicable laws and regulations.

    Community Standards
    Adhere to our community guidelines, which prohibit harmful, dangerous, or illegal content. This includes but is not limited to content that promotes self-harm, violence, or illegal activities.
  • 5
    Reporting Violations
    If you encounter content or behavior that you believe violates these Terms, use the reporting tools provided on the Platform. We take all reports seriously and will investigate them promptly.

Remember: Your conduct on the Platform reflects not only on you but also on the Creato community. We reserve the right to take action against any behavior that we determine, in our sole discretion, to be harmful to our community or Platform integrity.

5. Intellectual Property

5.1 Creato's Intellectual Property

The Platform, including all of its content, features, and functionality -- such as text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, source code, and the design, selection, and arrangement thereof -- is owned by Creato, its licensors, or other providers of such material and is protected by Indonesian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are not permitted to copy, reproduce, modify, distribute, publish, transmit, create derivative works from, publicly display, or exploit any content from the Platform without the express prior written permission of Creato, except as may be allowed by applicable law.

5.2 Trademarks

The Creato name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Creato or its affiliates or licensors. You must not use such marks without the prior written permission of Creato. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

5.3 Feedback and Suggestions

If you provide Creato with any feedback, suggestions, comments, or ideas regarding the Platform (collectively, "Feedback"), you grant Creato a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, and distribute such Feedback for any purpose, without any obligation of compensation or acknowledgment to you.

Content Ownership: While Creato retains ownership of the Platform itself, you retain all rights to the content you create and upload. However, by uploading content, you grant Creato a license to use, distribute, and display that content as described in Section 6 below.

6. User-Generated Content License

6.1 License Grant

By uploading, posting, sharing, or otherwise making content available on the Platform ("User Content"), you grant Creato and its affiliates, sublicensees, and users a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

  • Use, reproduce, modify, adapt, publish, translate, and create derivative works from your User Content
  • Distribute, perform, display, and make available your User Content in connection with operating and providing the Platform
  • Use your User Content for promotional, marketing, and informational purposes related to Creato, including on social media and advertising channels
  • Allow other users to view, stream, download (where enabled), share, and interact with your User Content in accordance with the Platform's features and your privacy settings

6.2 Your Representations and Warranties

By submitting User Content, you represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to upload the content and to grant the license described above
  • Your User Content does not infringe or misappropriate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party
  • Your User Content does not violate any applicable laws, regulations, or third-party agreements
  • Your User Content does not contain malware, viruses, or any other harmful or malicious code or technology
  • You have obtained all necessary consents from individuals who appear in your content, including parental consent for minors

6.3 Content Removal

You may delete your User Content at any time through the Platform's provided functionality. However, you acknowledge that copies of your User Content may remain viewable in cached or archived pages, or if other users have saved or shared your content, even after deletion. The license granted above continues for a commercially reasonable period after deletion to allow Creato to fully exercise the rights granted.

Important: Do not upload content that you do not have the right to share. If your User Content infringes on someone else's rights, you may be held legally liable, and your content will be removed in accordance with our DMCA Policy (Section 7).

7. DMCA & Copyright

7.1 Digital Millennium Copyright Act Compliance

Creato respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. We have adopted a policy to respond to claims of copyright infringement and to terminate the accounts of repeat infringers.

7.2 Submitting a DMCA Notice

If you believe that your copyrighted work has been infringed on the Platform, please submit a DMCA takedown notice to our designated copyright agent at dmca@creato.biz.id. Your notice must include the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (provide URLs or specific descriptions)
  • Information reasonably sufficient to permit us to contact you, including your address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

7.3 Counter-Notification

If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to dmca@creato.biz.id containing:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the court in which you are located

7.4 Repeat Infringer Policy

In accordance with the DMCA and applicable law, Creato will terminate the accounts of users who are determined to be repeat infringers. We evaluate repeat infringement based on the number of valid takedown notices received against a user's content and the circumstances surrounding each instance.

Filing a Claim: Please direct all DMCA takedown notices and counter-notifications to dmca@creato.biz.id. Filing a knowingly false DMCA notice may result in liability for damages under applicable law.

8. Prohibited Activities

You agree not to engage in any of the following activities on or through the Platform. This list is illustrative and not exhaustive -- any activity that Creato determines, in its sole discretion, to be harmful to the Platform, its users, or its operations may be prohibited:

    Illegal Activity
    Violating any applicable law, regulation, ordinance, or government order, including but not limited to intellectual property laws, privacy laws, export control laws, and anti-fraud statutes.

    Harassment and Abuse
    Harassing, threatening, intimidating, defaming, or abusing any other user, Creato employee, or third party. This includes stalking, cyberbullying, and publishing private information about others without consent (doxxing).
  • 3
    Spam and Unsolicited Communications
    Sending spam, chain letters, pyramid schemes, or any form of unsolicited or unauthorized advertising, promotional materials, or solicitation through the Platform.
  • 4
    Malware and Harmful Code
    Uploading, distributing, or transmitting any viruses, worms, Trojan horses, malware, ransomware, or any other harmful or destructive code or software through the Platform.
  • 5
    Platform Exploitation
    Exploiting, distributing, or publicly disclosing any Platform vulnerability, bug, or exploit for malicious purposes. Reverse-engineering, decompiling, or disassembling any portion of the Platform.
  • 6
    Impersonation
    Impersonating or attempting to impersonate any person or entity, including Creato employees, other users, celebrities, or public figures, or falsely stating or misrepresenting your affiliation with any person or entity.

    Unauthorized Access
    Gaining or attempting to gain unauthorized access to any portion of the Platform, other users' accounts, computer systems, or networks connected to the Platform, through hacking, password mining, or any other means.
  • 8
    Automation and Scraping
    Using automated systems, bots, scrapers, crawlers, spiders, or similar technologies to access, extract, or collect data or content from the Platform without Creato's prior written consent.
  • 9
    Content Manipulation
    Engaging in artificial engagement manipulation, including purchasing or selling likes, views, followers, or using services designed to artificially inflate engagement metrics.
  • 10
    Harmful Content
    Posting content that is obscene, pornographic (where prohibited), promotes violence, depicts animal cruelty, promotes self-harm or eating disorders, or is otherwise harmful to the community.

Zero Tolerance: Creato has zero tolerance for activities that endanger the safety of our users or compromise the integrity of our Platform. Violations may result in immediate account termination and, where applicable, reporting to law enforcement authorities.

9. Termination

9.1 Termination by Creato

We reserve the right, in our sole discretion and without prior notice, to suspend, restrict, or terminate your access to all or any part of the Platform at any time and for any reason, including but not limited to:

  • Your breach or violation of these Terms or any other Creato policies
  • Requests by law enforcement or other government agencies
  • Discontinuation or material modification of the Platform or any service offered on it
  • Unexpected technical issues or problems, including security vulnerabilities
  • Non-payment of any fees owed for premium features or services
  • Engaging in fraudulent, illegal, or harmful activities as determined by Creato

9.2 Termination by You

You may terminate your account at any time by using the account deletion feature available in your account settings or by contacting our support team at hello@creato.biz.id. Upon termination of your account:

  • Your right to access and use the Platform will immediately cease
  • All outstanding amounts owed by you to Creato remain payable
  • Your User Content may be deleted or retained in accordance with our data retention practices, as described in our Privacy Policy
  • Any licenses you granted to Creato regarding your User Content will continue for a commercially reasonable period to allow Creato to wind down services

9.3 Effect of Termination

Upon termination of your account, all provisions of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

Note: If your account is terminated for violating these Terms, you are prohibited from creating a new account or accessing the Platform in any manner. Any attempt to do so will result in further enforcement action.

10. Disclaimers

10.1 "As Is" and "As Available" Basis

THE PLATFORM AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CREATO EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10.2 No Warranty of Availability or Performance

CREATO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. CREATO DOES NOT WARRANT THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED OR THAT THE PLATFORM WILL OPERATE WITH ANY SPECIFIC LEVEL OF AVAILABILITY OR PERFORMANCE.

10.3 User Content Disclaimer

CREATO DOES NOT ENDORSE, APPROVE, OR VERIFY THE ACCURACY, QUALITY, OR LEGALITY OF USER CONTENT POSTED ON THE PLATFORM. CREATO EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONNECTION WITH USER CONTENT. YOU ACKNOWLEDGE THAT YOUR USE OF THE PLATFORM MAY RESULT IN EXPOSURE TO CONTENT THAT YOU FIND OBJECTIONABLE, INACCURATE, OR OFFENSIVE.

10.4 Third-Party Services and Links

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by Creato. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Creato shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.

Legal Disclaimer: The disclaimers in this section apply to the maximum extent permitted by applicable law. Some jurisdictions do not allow the exclusion of certain warranties, and in such cases, the above exclusions may not apply to you in their entirety.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Creato, its parents, subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers, and successors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • Your access to or use of the Platform, including any content you upload, post, or share
  • Your violation or alleged violation of any term of these Terms
  • Your violation or alleged violation of any rights of any third party, including intellectual property rights, privacy rights, or publicity rights
  • Your violation of any applicable law, regulation, or government order
  • Any claim that your User Content caused harm to a third party, including defamation, invasion of privacy, or emotional distress
  • Any dispute between you and another user of the Platform
  • Your negligence, willful misconduct, or fraudulent behavior

Creato reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will fully cooperate with Creato in asserting any available defenses. You may not settle any claim or action with a third party without Creato's prior written consent.

Your Obligation: The indemnification obligation ensures that Creato is protected from claims arising from user misconduct. If you receive a legal notice related to your use of the Platform, notify us promptly so we can assist where appropriate.

12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, you agree to first attempt to resolve the dispute informally by contacting Creato at legal@creato.biz.id. We will make a good faith effort to resolve the dispute within 60 days of receiving your written notice describing the nature of the dispute and the relief sought.

12.2 Mediation

If the dispute is not resolved informally within 60 days, both parties agree to participate in good faith in mediation before a mutually agreed-upon mediator. The costs of mediation will be shared equally between the parties. Mediation will take place in the jurisdiction specified in Section 13.

12.3 Binding Arbitration

If mediation is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the Indonesian National Board of Arbitration (BANI) in accordance with its rules in effect at the time of filing. The arbitration shall be conducted by a single arbitrator, and the proceedings shall be conducted in the Indonesian language.

The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction. You agree that arbitration shall be conducted on an individual basis and not as a class action or other representative action.

12.4 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND CREATO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

12.5 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court, provided that the action is brought and maintained on an individual basis and not as a class action or other representative action.

13. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without giving effect to any choice or conflict of law provisions or rules that would cause the application of the laws of any jurisdiction other than Indonesia.

You agree that the Platform shall be deemed to be based in Indonesia and that these Terms and all disputes are subject to the exclusive jurisdiction of the competent courts of Indonesia, subject to the arbitration provisions in Section 12.

If you are accessing the Platform from a country or jurisdiction with laws that are different from those of Indonesia, your access to the Platform may not be legal, and you are solely responsible for complying with all applicable local laws, rules, and regulations.

International Users: If you access the Platform from outside Indonesia, you do so at your own initiative and are responsible for compliance with all applicable local laws in your jurisdiction.

14. Changes to Terms

Creato reserves the right, in our sole discretion, to modify, amend, or replace these Terms at any time. When we make material changes to these Terms, we will provide notice to users through one or more of the following methods:

  • Posting a prominent notice on the Platform or on our website at creato.biz.id for a reasonable period before the changes take effect
  • Sending an email notification to the email address associated with your account
  • Displaying an in-app or in-platform notification requiring your acknowledgment
  • Updating the "Last Updated" date at the top of this page

Material changes will take effect no sooner than 30 days after notice is provided. Non-material changes may take effect immediately upon posting. If you object to any changes to these Terms, your sole remedy is to cease using the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of such changes.
